Kalshi Walks Back Exclusivity Claims on Giants and Braves Prediction-Market Partnerships

The retraction signals how little legal teams trust platform categories still arguing with regulators.

Kalshi retracted exclusivity language from its January partnership announcements with the San Francisco Giants and Atlanta Braves. The prediction-market platform described the claim as an accidental overstatement in a correction filed this week. Neither club granted exclusive rights to the CFTC-regulated exchange.

The deals, announced 11 days apart in early January, positioned Kalshi as the official prediction-market partner for both franchises. The company's initial press materials stated the agreements were exclusive arrangements, language repeated in media coverage and executive interviews. That framing mattered. Exclusivity commands premium pricing in sponsorship deals and signals category ownership to competing platforms eyeing the same inventory. The correction removes both.

The retraction creates two problems for Kalshi's growth team. First, it undermines the platform's negotiating position with the 28 MLB clubs not yet under contract. Teams now know Kalshi lacks category protection with its anchor partners, making comp analysis murkier and opening the door for Polymarket, Robinhood's new prediction vertical, or niche platforms to bid simultaneously. Second, it raises diligence questions for corporate partners evaluating the space. If legal teams at two marquee franchises missed or rejected exclusivity language, the category's contract standards remain unsettled. That uncertainty shows up in deal velocity. Kalshi has announced zero additional MLB partnerships since the Braves deal on January 14, despite the league office signaling openness to the category in December.

The Giants and Braves declined to comment on the revised terms, citing standard confidentiality clauses. Neither club has announced competing prediction-market deals since the Kalshi agreements. That silence is worth parsing. Teams typically rush to market when exclusivity lapses, announcing secondary partners within 30 to 60 days to extract value from the open window. The quiet suggests either lingering internal caution about the category or non-compete language buried elsewhere in the contracts. Kalshi's competitors are watching the same calendar.

Prediction markets occupy regulatory gray space that makes partnership teams nervous. Kalshi operates under a CFTC no-action letter covering event contracts; Polymarket settled an enforcement action in 2022 and relocated offshore; new entrants like Foresight Markets are still arguing with regulators over what constitutes a permitted market. That fragmentation makes exclusivity claims hard to enforce and harder to price. A team granting exclusive rights to a platform that could face sudden regulatory limits takes on tail risk most general counsels prefer to avoid. The retraction suggests the Giants and Braves felt the same.

The correction appeared without a corresponding press release or executive statement, filed quietly through updated partnership pages on both team websites. That approach limits reputational damage but guarantees every rival platform now has the revision in their pitch decks. Kalshi's head of partnerships did not respond to a request for comment on pricing adjustments or future deal structures.

Watch whether Kalshi converts any of the six MLB clubs reportedly in late-stage discussions before Opening Day on March 27. If those deals close without exclusivity, the category pricing model resets lower. Also watch whether the Giants or Braves announce a second prediction-market partner before the All-Star break in July. That move would confirm the door is open and signal how much rope teams are willing to give a category still explaining itself to state attorneys general.

The takeaway
The exclusivity retraction resets prediction-market pricing and opens MLB partnership inventory rival platforms thought was locked.

Your next customer won't visit your website. Their AI will.
AI assistants have quietly taken over the first step of buying — they answer from catalogs they can read and shortlist whoever can actually ship. Two questions now decide whether you exist to that buyer: can a machine read your catalog, and can you fulfill the order. Most brands fail one or both and never find out why the orders went elsewhere. The winners of this shift aren't the loudest. They're the most readable. Build for the machine that's about to do the shopping.
